Learn How to Avoid Potential Export Violations

Constellis senior director of export & AFT compliance, Lee Gortman, was featured in the June 2016 issue of The Property Professional Magazine, the official magazine of the National Property Management Association (NPMA). Gortman’s feature, Property Management and Export Compliance, poses the question: Is it necessary for property management departments to communicate with export compliance departments? Gortman’s response, “Yes, absolutely.” He goes on to discuss the importance of fostering synergy and establishing open and effective communication channels between property management and export compliance in the workplace. “If the property management department does not communicate with the export compliance department, the company may face serious violations surrounding U.S. export laws and regulations”, says Gortman.

Gortman advises that for companies to avoid violations, property personnel must communicate with the export compliance department regarding the classification of controlled property and when the status of controlled property changes. Additionally, companies must train employees on export compliance to have a thorough understanding of the property controlled under an export license. “To maintain 100-percent export compliance, companies must register with the DDTC and BIS as an exporter before training employees”, Gortman explains. “If employees are not made aware of what export laws and regulations they must adhere to, the company has put itself at risk for an export violation.”
